BOSNIA & HERZEGOVINA - DATA PROTECTION OVERVIEW

As part of EU approximation process, Bosnia and Herzegovina ('BiH') has taken the obligation to harmonise all of its legislation with the EU laws. Therefore, BiH is obliged to harmonise its legislation with the Acquis Communautaire, which includes the harmonisation of the Law on the Protection of Personal Data No. 49/06 ('the Law') with EU regulations in the field of personal data protection.

The main data protection law in BiH is the Law on the Protection of Personal Data No. 49/06 ('the Law'). The Agency for Personal Data Protection in Bosnia and Herzegovina ('AZLP') prepared the draft of the new Law on Personal Data Protection ('the Draft Law') based on General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR') of the European Parliament and of the Council. Implementation of the GDPR will be resolved within that framework.
